Felonies

Felony Charges

This firm has represented clients accused of each level of felony, including first degree murder. Felony offenses are classified as state jail felonies, third degree felonies, second degree felonies, and first-degree felonies. All felonies are punishable by up to a $10,000 fine.  If you have prior criminal history, felonies can sometimes be enhanced pursuant to a variety of enhancement and/or habitual "repeat offender" statutes. 

 

State jail felonies, the lowest level of felony, are punishable by no less than 180 days and no more than 2 years in a state jail facility. Examples of state jail felonies include DWI with a child in the vehicle, identity theft, evading arrest in a vehicle, and possession of less than an ounce of certain non-prescription illegal drugs such as cocaine, meth, or heroin.

 

Third degree felonies are punishable by 2-10 years in prison. Examples of third-degree felonies include continuous family violence, DWI for the 3rd time or more, causing injury to a child, convicted felons in possession of a firearm, deadly conduct, and possession of 1-4 ounces of certain non-prescription illegal drugs such as cocaine, meth, or heroin.

 

Second degree felonies are punishable by 2-20 years in prison.  They include robbery, aggravated assault, and manslaughter, including intoxication manslaughter. 

 

First degree felonies are punishable by 5-99 years in prison. They include murder, aggravated kidnapping, aggravated robbery, aggravated assault that causes seriously bodily injury, and murder.  Sometimes, first degree felonies can be enhanced such that the punishment range is 15 years - life, or even 25 years - life in prison.

 

Capital Murder is the only crime above a first-degree felony.  It is punishable by life in prison or death.  Attorney Alice does not accept capital cases because of the unique procedural rules required in death penalty cases.
